Amendments in SCUG Service Rules, 2020 | Government of Sindh Law Department | September 18, 2020

With reference to letter No.SLGB/SCUG/A0/ENG-11/AMEND/2020/1138 dated the 12th of August 2020 on the subject noted above. And to state that the draft amendments in the Sindh Councils Unified Grades Service Rules. 2020. That received with your letter under reference, have been examined. The following points have arisen while vetting the draft:-

• That the post of Sub-Engineer (BS-11) in various Departments departments have upgraded to the post of Sub-Engineer (BPS-16). That is in view of the decision of the Honorable Supreme Court of Pakistan. The court passed in CMA No.166-K vide circular letter of the Finance Department (copy enclosed), which now needs to be mentioned as Sub-Engineer (BS-16).

• In view of the observations at (a) above, the next promotion of the Sub-Engineer should be for the Assistant Executive Engineering (Civil)/(Electrical & Mechanical) (BS-17) instead of Assistant Engineer (BS-16). Further the ratio for promotion for B.E./B.Sc: (Engg (Civil/Electrical/Mechanical) and B.Tech: Degrees/qualification holders should revisit. And it should a rationale in accordance with the ration prescribed in other Government Departments.

• As regards the amendment proposed at Sr. No.4 in Juxta-position, it is pertinent to mention here that the posts in the Engineering Branch are meant for such categories of Engineers. There should be no room available for the persons who are non-Engineers. They have already reserved the quota for the Engineers who are B.E/B.Sc : /B.Tech and Diploma holders. As the posts are purely meant for Engineering Branch. As such it would not be necessary to include the amendment in rule 2(5) as proposed.

مذکورہ موضوع پر 12 اگست 2020 کو خط نمبر SLGB / SCUG / A0 / ENG-11 / Amend / 2020/1138 کے حوالے سے۔ اور یہ بیان کیا گیا ہے کہ سندھ کونسلوں کے متحد گریڈ سروس رولز میں ترمیم کے مسودے کو 2020. جو حوالہ کے تحت آپ کے خط کے ساتھ موصول ہوا ہے ، اس کی جانچ پڑتال کی گئی ہے۔ ڈرافٹ کی جانچ پڑتال کے دوران درج ذیل نکات پیدا ہوئے ہیں: –

کہ مختلف محکموں میں سب انجینئر (بی ایس 11) کے عہدے پر سب انجینئر (بی پی ایس 16) کے عہدے پر اضافہ ہوا ہے۔ یہ سپریم کورٹ آف پاکستان کے فیصلے کے پیش نظر ہے۔ عدالت نے محکمہ خزانہ کے CMA نمبر 1666-K کے سرکلر لیٹر (کاپی کو بند) میں منظور کیا ، جس میں اب سب انجینئر (BS-16) کے طور پر ذکر کرنے کی ضرورت ہے۔

اوپر (ایک) پر مشاہدات کے پیش نظر ، سب انجینئر کی اگلی ترقی اسسٹنٹ انجینئر (بی ایس 16) کی بجائے اسسٹنٹ ایگزیکٹو انجینئرنگ (سول) / (الیکٹریکل اینڈ میکینیکل) (بی ایس 17) کے لئے ہونی چاہئے۔ اس کے علاوہ B.E./B.Sc: (انجینئر (سول / الیکٹریکل / مکینیکل) اور B.Tech: ڈگری / قابلیت رکھنے والوں کو دوبارہ نظرثانی کرنی چاہیئے۔ اور یہ دوسرے سرکاری محکموں میں مقرر راشن کے مطابق ایک عقلیہ اختیار کرنا چاہئے۔

جوکسٹا پوزیشن میں سینئر نمبر 4 میں تجویز کردہ ترمیم کے حوالے سے ، یہاں یہ ذکر کرنا مناسب ہے کہ انجینئرنگ برانچ میں پوسٹس انجینئرز کی اس قسم کے لئے ہیں۔ ایسے افراد کے لئے کوئی جگہ دستیاب نہیں ہونی چاہئے جو غیر انجینئر ہیں۔ انہوں نے ان انجینئرز کے لئے کوٹہ پہلے ہی محفوظ کر لیا ہے جو B.E / B.Sc: /B.Tech اور ڈپلومہ ہولڈر ہیں۔ چونکہ پوسٹس خالص طور پر انجینئرنگ برانچ کے لئے ہیں۔ اس طرح ، جیسا کہ مجوزہ قانون 2 (5) میں ترمیم کو شامل کرنا ضروری نہیں ہوگا۔
